1. Acceptance of Terms

By accessing or using the website hammerwash.com (the “Site”) and/or any services provided by Hammer Wash House Care (“Company,” “we,” “us,” “our”), you (“you,” “Your,” “Customer”) agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, please do not use the Site or our services.

2. Services

We provide exterior house washing, driveway washing, asphalt coating, concrete sealing, fence pressure-washing, deck & patio cleaning (the “Services”). Any descriptions, images or other content on the Site are for informational purposes only and do not guarantee results.

3. Quotes, Booking & Payment

3.1 All quotes provided by us are estimates only unless explicitly stated otherwise in writing.
3.2 Service booking is subject to availability and confirmation by us.
3.3 Payment must be made as specified in the quote and/or invoice. We reserve the right to pause or cancel services if payment is not received.
3.4 For promotional or membership offers, any discount or benefit is subject to the terms of that offer (for example the “Membership Club” plans) and may be changed or discontinued at our discretion.

4. Membership & Promotions

4.1 If you sign up for a membership (e.g., “Basic Plan”, “Premium Plan”), you will receive the benefits described in the promotion subject to these Terms and any additional membership terms.
4.2 Benefits (e.g., discount percentages, free services) apply only while your membership is active and in good standing.
4.3 We reserve the right to modify, suspend, or terminate any membership or promotion with notice. Each membership plan, once purchased, will remain active and valid until the end of the calendar year in which it was purchased, regardless of when it was started, unless canceled earlier by the customer.

5. Service Performance & Results

5.1 You acknowledge that results from our Services may vary depending on the condition of the surfaces, weather, materials, and other factors outside our control.
5.2 We make no warranty, expressed or implied, regarding specific outcomes (including but not limited to complete stain removal, crack-proof surfaces, or exact lifespan).
5.3 You agree to allow us reasonable access to the property, safe working conditions, and to remove any obstacles or hazards that may hinder performance of the Services. If unsafe or inaccessible, we may postpone, reschedule or cancel the service.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images and designs (“Content”) is owned by or licensed to us and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute or commercialize the Content without our prior written permission.

7. Limitation of Liability

To the fullest extent permitted by law:

We (and our officers, employees, agents) shall not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of or inability to use the Site or our Services.
Our total aggregate liability to you for all claims (whether contract, tort or otherwise) shall not exceed the amounts you paid us for the applicable service during the 12 months preceding the claim.
Nothing in these Terms limits liability that cannot be excluded by applicable law (e.g., death or personal injury caused by our negligence).

8. Indemnification

You agree to indemnify, defend and hold harmless the Company, its affiliates, officers, directors, agents and employees from any claims, liabilities, costs or expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Site or Services.

9. Termination & Suspension

We may suspend or terminate your access to the Site or provision of Services at any time for any reason, including if you breach these Terms. Upon termination, your obligations under Sections 6 (Intellectual Property), 7 (Limitation of Liability), and 8 (Indemnification) will survive.

10. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of [insert specific county/region, e.g., Hamilton, Ontario].
